Notice of Privacy Practices

 

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

 

BreatheSuite Inc. (“BreatheSuite”) is committed to protecting the privacy of your medical information. We understand that your medical information is personal and we are committed to protecting it. This notice applies to all of the records of your care generated by BreatheSuite, whether made by our staff or your personal physician.

 

This Notice of Privacy Practices describes the practices that we will follow with respect to the privacy of the health information of users of this site and our mobile applications and related services (“Services”).

 

We are required by law to:

  • Make sure that medical information that identifies you is kept private

  • Give you this notice of our legal duties and privacy practices with respect to medical information about you

  • Follow the terms of the notice that is currently in effect

 

We may use and disclose medical information about you for the following reasons:

  • Treatment: We may use medical information about you to provide you with medical treatment or services. We may disclose medical information about you to doctors, nurses, technicians, medical students, or other personnel who are involved in taking care of you. This includes sharing your information with other healthcare providers that are involved in your treatment, such as specialists or laboratories.

  • Payment: We may use and disclose medical information about you so that the treatment and services you receive may be billed to and payment may be collected from your insurance company, Medicare or Medicaid, or from you. This includes sharing your information with billing and collections companies that assist us with billing and insurance claims.

  • Health Care Operations: We may use and disclose medical information about you for our operations. These uses and disclosures are necessary to run our practice and make sure that all of our patients receive quality care. This includes using your information to evaluate the performance of our staff, evaluate the effectiveness of our treatment methods, and to conduct audits and compliance reviews.

  • Appointment Reminders: We may use and disclose medical information to contact you as a reminder that you have an appointment for treatment or medical care. This may include phone calls, text messages, or emails.

  • Treatment Alternatives: We may use and disclose medical information to tell you about or recommend possible treatment options or alternatives that may be of interest to you. This may include information about clinical trials, new treatment methods, or other healthcare providers that may be able to assist you.

  • Research: Under certain circumstances, we may use and disclose medical information for research purposes. This may include sharing your information with researchers that are conducting studies on new treatment methods or medical conditions. All research involving patient information will be conducted under strict oversight to ensure that your privacy rights are protected.

  • As Required by Law: We will disclose medical information about you when required to do so by federal, state, or local law. This may include reporting certain communicable diseases or other public health risks, responding to court orders or subpoenas, or reporting abuse or neglect.

  • Public Health: We may disclose medical information about you for public health activities and to prevent or control disease, injury or disability. This may include reporting information to the CDC or other public health authorities for the purpose of tracking and controlling the spread of certain diseases.

  • Health Oversight: We may disclose medical information to a health oversight agency for activities authorized by law. This may include audits or inspections by state or federal agencies that regulate healthcare providers.

  • Legal Proceedings: We may disclose medical information about you in the course of any judicial or administrative proceeding. This may include providing information in response to a court order or subpoena, or providing information in a lawsuit or insurance claim.

  • Law Enforcement: We may disclose medical information if asked to do so by a law enforcement official. This may include providing information in response to a warrant, subpoena, orother legal process, or to report a crime that has occurred on our premises.

  • Coroners, Medical Examiners, and Funeral Directors: We may disclose medical information to a coroner, medical examiner or funeral director as necessary for their duties.

  • Organ and Tissue Donation: We may disclose medical information to organizations that handle organ and tissue donation and transplantation.

  • Research on Deceased Individuals: We may disclose medical information about deceased individuals to researchers who are conducting research on the cause of death or other medical conditions.

  • Military and Veterans: If you are or were a member of the military, we may disclose medical information about you as required by military command authorities. We may also disclose medical information about veterans to the Department of Veterans Affairs.

  • Workers' Compensation: We may disclose medical information about you as necessary to comply with workers' compensation laws and other similar legally-established programs.

  • National Security: We may disclose medical information about you as required by military command authorities or federal intelligence agencies for national security and intelligence activities.

  • Inmates: If you are an inmate of a correctional institution or under the custody of a law enforcement official, we may disclose medical information about you as necessary for your health and the health and safety of other individuals.

 

We will obtain your written authorization before using or disclosing any medical information about you for any purpose not covered by this notice. You may revoke your authorization at any time in writing.

 

You have the following rights with respect to your medical information:

  • The right to inspect and copy your medical information

  • The right to request that we amend your medical information if you believe it is incorrect or incomplete

  • The right to receive an accounting of certain disclosures we have made of your medical information

  • The right to request that we restrict how we use or disclose your medical information

  • The right to receive confidential communications of your medical information

  • The right to receive a paper copy of this notice upon request

 

If you believe that your privacy rights have been violated, you may file a complaint with us or with the Secretary of the Department of Health and Human Services. To file a complaint with us, please contact our Privacy Officer at privacy@breathesuite.com. We will not retaliate against you for filing a complaint.

 

We reserve the right to change the terms of this notice and to make the new notice provisions effective for all medical information that we maintain. We will post a copy of our current notice in our facility and on our website and you may also request a copy of our notice at any time.
